These Terms of Service ("Terms") govern your use of the FairEatsApp waitlist at faireatsapp.com. By joining the waitlist, you agree to these Terms. If you do not agree, do not join the waitlist.
FairEatsApp LLC is an Arizona limited liability company. These Terms are governed by Arizona law.
These Terms cover the waitlist phase of FairEatsApp — the period during which we are collecting signups but not yet delivering food or processing payments. When FairEatsApp launches for real, a new, longer Terms of Service will be published that covers the live service, and you will be notified in advance.
1. What FairEatsApp is — and isn't — right now
- Right now: FairEatsApp is a waitlist. You can sign up to be notified when FairEatsApp launches in your city. That is it. No food is being delivered. No money is being collected. No service is being rendered.
- What the waitlist will let you do: receive a notification by email and/or SMS when FairEatsApp launches where you live.
- What the waitlist does NOT promise: a specific launch date, a guarantee that we will launch in your city, or that your waitlist position will translate into any particular order of access when the service goes live.
- When FairEatsApp launches for real: these Terms will be replaced by a new, longer set of Terms specifically for the live service. You will be notified before that happens.
2. Who can join
You must be at least 13 years old to join the waitlist. If you are under 18, you represent that a parent or legal guardian has consented on your behalf.
3. Accurate information
You agree to provide accurate information on the waitlist form. Submitting fake names, disposable email addresses, fake phone numbers, or fake ZIP codes dilutes the waitlist data we use to prioritize city launches. We reserve the right to remove entries that appear to be fake, duplicate, automated, or abusive.
4. Contact consent
By submitting your email and phone number on the waitlist form, you consent to receive:
- A confirmation email acknowledging that you joined the waitlist.
- A launch notification email and/or SMS when FairEatsApp becomes available in your city.
- Occasional brief updates about major project milestones (for example, when a new city is added to the launch list).
You can unsubscribe from email updates at any time by replying "unsubscribe" or emailing hello@faireatsapp.com. For SMS, reply STOP. Standard message and data rates may apply to SMS; consult your mobile carrier for details.
5. No fee for the waitlist
Joining the waitlist is free. FairEatsApp does not ask for payment information during the waitlist phase. Anyone claiming to charge for waitlist access is not affiliated with us.
6. Our zero-commission promise
FairEatsApp is built on the principle of zero commission: we take 0% from restaurants, 0% from drivers, and 0% from customers on every transaction. Operating costs will be covered by rotating local sponsors when the service launches. This promise is the entire point of the product. If we ever change it, we will be explicit and public about it.
"Zero commission" specifically means FairEatsApp takes no cut— not that the customer pays exactly the restaurant's menu price. When the live service launches, a customer's receipt will show a line-itemized breakdown:
- The restaurant's menu price, which the restaurant is required to keep in sync with its in-store / walk-in / takeout price for the same item.
- The delivery driver's winning bid, set by the driver through a reverse-auction mechanism — not by FairEatsApp.
- Any optional tip the customer chooses to add, which goes 100% to the driver.
- Credit card processing fees charged by the payment network (for example, Stripe's standard per-transaction fee), passed through to the customer at cost. These fees are paid to the payment processor, not to FairEatsApp, and are not a FairEatsApp revenue stream.
The zero-commission principle is a product commitment, not a legal contract — these Terms do not create any enforceable right for restaurants, drivers, or customers to any particular pricing structure at launch. That framework will live in the separate Terms of Service published when the live service launches.
7. Intellectual property
The FairEatsApp name, logo, website design, and source code are owned by FairEatsApp LLC. You may not copy, modify, or create derivative works based on any of this material without our written permission, except for normal use of the website as a visitor.
User content on the waitlist form (your name, email, phone, ZIP, role, referral code) remains yours. By submitting it, you grant FairEatsApp a limited license to store and process it for the purposes described in the Privacy Policy.
8. Prohibited conduct
You agree not to:
- Use automated scripts, bots, or scrapers to submit waitlist entries.
- Attempt to access any part of the website that is not publicly accessible (such as the admin dashboard).
- Probe, scan, or test the vulnerability of our systems without written permission.
- Interfere with other users' access to the website.
- Misrepresent yourself as another person on the waitlist form.
- Submit information that is false, misleading, fraudulent, or unlawful.
- Use the website in violation of any applicable law.
9. No warranty
The FairEatsApp website and waitlist are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components. We do not warrant that any particular launch schedule will be met.
10. Limitation of liability
To the maximum extent permitted by Arizona law, in no event will FairEatsApp LLC, its members, officers, employees, agents, or affiliates be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the waitlist or website, whether based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of the waitlist phase shall not exceed one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In those jurisdictions, the limitations above apply only to the extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless FairEatsApp LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms,
- Your violation of any law or third-party right, or
- Any information you submit on the waitlist form that turns out to be false, misleading, or unauthorized.
12. Termination
We may remove your waitlist entry, restrict your access to the website, or take other appropriate action at any time if we reasonably believe you have violated these Terms. You may withdraw from the waitlist at any time by emailing hello@faireatsapp.com.
13. Changes to these Terms
We may update these Terms as the project evolves. The "Last updated" date at the top is the authoritative version indicator. Material changes will be announced by email at least 14 days before they take effect. Remaining on the waitlist after that date constitutes acceptance of the updated Terms.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the waitlist shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16. Entire agreement
These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and FairEatsApp LLC regarding the waitlist.
